The City Government of Malaybalay, headed by Mayor Jay Warren R. Pabillaran, has released Executive Order (EO) No. 238 Series of 2022, an order deputizing members of the Philippine Wide Anti-Smoking Operation for Health (PWASOH) as enforcers of Malaybalay City, on November 4, 2022.

There are a total of 46 PWASOH enforcers deputized by the order and tasked with apprehending individuals caught in violation of Section 5 of Malaybalay City Ordinance No. 885, otherwise known as “Smoke-free Ordinance of the City of Malaybalay.”

This EO is based on Republic Act 8749, also known as the “Philippine Clean Air Act of 1999,” which mandates the local government units to implement the prohibition of smoking inside a public building or an enclosed public place, including public vehicles and other means of transport, or in any enclosed area outside of one’s private residence, private place of work, or any duly designated smoking area.

The deputized individuals will serve as enforcers of the said ordinance. The order shall take effect immediately on the date of issuance by the local chief executive.
